It varies by state--looks like it's usually a felony. You can find a summary of state statutes on identity theft on the National Conference of State Legislatures website: http://www.ncsl.org/?tabid=12538

If you use identity theft to commit another crime, the Identity Theft Penalty Enhancement Act will add additional time onto your sentence.

So if get caught would be in lot'sa trouble Vanessa and I don't purposely do it either. I loose control with my illness and did tell my psychiatrist about it and now he has adjusted my meds. I think your situation is that your parents did it to you and i do feel so much guilt after and did it to my parents, my own kids and other people as well. So far only my kids caught on and feel so ashamed. Thanks for the links and your time means so much to me. God Bless xoxo Annie
